2 · How a contract is formed

The presentation of works on this site is not a binding offer. By clicking the buy button and completing payment you make a binding offer to purchase. The contract comes into effect when we confirm your order by email or hand the work over for shipping.

Every work is a unique piece and can only be sold once. If a work has already been sold, no contract is formed and any payment is refunded in full.

3 · Prices and payment

All prices are final prices. As a small business under § 19 UStG, no VAT is shown.

Payment is handled by Stripe. Which payment methods are available is shown during checkout.

4 · Shipping and delivery

Shipping is included in the price. We currently ship to: Germany.

Works are shipped insured within ten working days of payment being received. Unique pieces are packed individually; for large formats the time may be a few days longer, in which case we will tell you.

5 · Right of withdrawal

Consumers have a right of withdrawal. The details are set out in the withdrawal policy below.

6 · Retention of title

The work remains our property until it has been paid for in full.

7 · Warranty and transport damage

Statutory warranty rights apply. Traces of the making — brush marks, edges, the texture of the canvas — are characteristics of an original work, not defects.

If a work arrives damaged, please photograph the packaging and the work before unpacking further and contact us. That makes the insurance claim considerably easier for both of us.

8 · Copyright

Buying a work transfers ownership of the physical object. Rights of use — reproduction, publication, commercial exploitation — remain with the artist.

Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving a reason.

The withdrawal period is fourteen days from the day on which you, or a third party named by you who is not the carrier, took possession of the goods.

To exercise your right of withdrawal you must inform us — Nelson Kleinmann, Fliederweg 6, 23863 Bargfeld-Stegen, nelson@fliedernetz.de — by means of a clear statement (for example a letter sent by post or an email) of your decision to withdraw. You may use the model form below, but you do not have to.

To meet the withdrawal deadline it is sufficient to send your notice before the period expires.

Consequences of withdrawal

If you withdraw from this contract we shall reimburse all payments received from you, including the costs of delivery, without undue delay and no later than fourteen days from the day on which we receive notice of your withdrawal. We use the same means of payment you used for the original transaction; you will not be charged any fees for this reimbursement.

We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent them back, whichever is the earlier.

You must send the goods back without undue delay and no later than fourteen days from the day on which you notify us of the withdrawal. You bear the direct cost of returning the goods.

You are liable for any diminished value of the goods resulting from handling other than what is necessary to establish their nature, characteristics and functioning.
